These are the terms and conditions (“Terms and Conditions”) upon which we supply Tickets and permit to entry to THE CUBE.

  1. DEFINITIONS

In these terms and conditions, the following definitions shall apply:

THE CUBE: THE CUBE, Unit B3.A, 14 Charter Street, Canary Wharf, London, E14 5GZ, or any part of it;

Event outside our control: Any act or event beyond our reasonable control, including without limitation epidemics of infectious diseases, war (whether declared or not), threat of war, strikes, lock-outs or other industrial action by third parties, civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster, or failure of public or private telecommunications networks or impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport.

’Us’/’We’/’Our’: Mellors Group UP No 2 Limited (Company Registration Number 13501456) registered in England and Wales, whose registered office address is at 57 Front Street, Arnold, Nottingham, Nottinghamshire, United Kingdom, NG5 7EA trading as Urban Playground.

Ticket: A valid ticket allowing the holder entry to the Attraction.

2.2          When contacting us please provide as much information as possible in reference to your booking.

  1. BOOKINGS

3.1          These Terms and Conditions apply whether you make a booking via our website, by email, post, telephone or in person.

3.2          You will submit your booking to us but this does not mean we have accepted it. Our acceptance of your booking will only occur when we send you a booking confirmation at which point a contract will come into existence between you and us.

3.3          We do not accept bookings from persons under the age of 18.

3.4          Tickets you purchase are for personal use and cannot be exchanged, transferred or sold on for profit, loaned or given away to or used by a third party.  If you breach this condition, we will be entitled to refuse access to THE CUBE and cancel the Tickets without compensation.

3.5          To prevent fraud, we may carry out checks or you may be asked to provide additional identification after your booking so we can verify your purchase as legitimate. If you refuse to provide us with the additional identification and/or we suspect fraud, we may cancel your booking and/or Tickets.

3.6          We will process your personal details in accordance with these Terms and Conditions and our Privacy Policy. You acknowledge that the processing of your personal information is necessary for us to perform our contract with you. We also reserve the right to use your personal details to contact you in relation to service information, including, but not limited to, information about changes to these Terms and Conditions.

3.7          You must inform us of any change of address, contact phone number or email address, both before and after receipt of the tickets. This can be done via the my account area on the website.  Our contact details are included in these Terms and Conditions. Our preferred method to contact you is email. You should take care to provide a current, valid email address and be aware that your email filter settings may treat our emails as spam or direct them to your junk folder.

3.8          We operate a dynamic pricing model, meaning that ticket prices may go up or down. Throughout the year we may offer seasonal promotions and discounts. The price of your Ticket(s) will be confirmed at the time of your booking.

3.9          We try to ensure all prices on our website are accurate, but errors may occur. If we discover an error in the price of Tickets that you have ordered, we will contact you by email as soon as possible using the email address you provided when booking your ticket and we will give you the option of either cancelling your booking (in which case you will be refunded the price of Tickets and any booking, transaction or supplementary fees you have paid) or continuing to purchase the Ticket(s) at the correct price. We will not process your order until we have your instructions. If we are unable to contact you using the contact details you provided during the booking process within a reasonable period of time, we will treat the booking as cancelled and notify you by email.

3.10        By making a booking you agreeing to our disclaimer which can be viewed at https://bookthecube.com/disclaimer/

3.11        If you are making the booking on behalf of others in your group, it is your responsibility to ensure that these additional players agree to these Terms and Conditions and are in receipt of all relevant information relating to the booking. We shall not be responsible if members of your group are unable to participate, as a result of you failing to provide them with all the relevant information.

  1. DELIVERY

4.1          Tickets will be sent to you by email.

4.2          It is your responsibility to ensure that you have provided us with a valid email address when making your booking.

4.3          Tickets must either be printed or displayed on a digital device when arriving at THE CUBE. You are then required to utilise your unique QR code to check-in to The CUBE.  It is your responsibility to ensure you have access to the QR codes provided for use at THE CUBE. We will not be responsible if you do not have the QR codes to play. No refunds will be given.

4.4          It is your responsibility to check your Tickets upon receipt and advise us promptly of any errors. Mistakes made when ordering cannot always be corrected and any corrections are discretionary and may incur a fee. Refunds are not available.

  1. CANCELLATION, CHANGES AND REFUNDS

5.1          Unless specifically stated otherwise in these Terms and Conditions, refunds are not available in any circumstances. This does not affect your statutory rights as a consumer.

5.2          We reserve the right to vary the opening and closing dates and times of THE CUBE and to close, remove or cancel all or any part of the events or facilities within THE CUBE for any reason including, but not being limited to technical, health and safety and/or operational reasons or due to special events or private functions.

5.3          You should check that your booking is going ahead at the scheduled date and time as we cannot guarantee to inform you of any changes to or cancellation of your booking. We will not be responsible for any costs that you may incur for travel, accommodation, any other related goods or service or other compensation.

5.4          If we do cancel your booking or make significant changes to THE CUBE, date, or session time, we will endeavour to inform you in advance by email using the email address you provided when making your booking. In urgent cases, we may attempt to contact you by telephone using the contact number you have provided when making your booking.

5.5          If we need to reschedule your booking you will be given the option of exchanging your tickets for a new date/time. Reschedule requests made within 24 hours of your booking may incur a £5 rebooking fee. Rescheduled tickets for sessions that have a higher value will incur a cost that is equal to the difference in price. Refunds are not available.

5.6          If we cancel a booking you will be given the option of exchanging your tickets for a new date/time. If the alternative options are unsuitable you may be offered a refund. Please note that any administration and transaction fees are not refundable in these circumstances.

  1. EVENTS OUTSIDE OUR CONTROL

We cannot accept liability or pay any compensation where the performance or prompt performance of our contractual obligations is prevented or affected by, or you otherwise suffer any damage or loss as a result of, an Event Outside of our Control.

  1. ATTENDING THE CUBE

7.1          Admission to THE CUBE is subject to these Terms and Conditions. If you breach any of these Terms and Conditions you may be refused admission or removed from THE CUBE without any right to a refund.

7.2          Whilst inside THE CUBE, you must comply with any reasonable instructions given to you by our personnel or any third party instructed on our behalf.

7.3          You will need to comply with Health & Safety rules and any security requirements we have in place at THE CUBE including, but not limited to, security searches for the safety of those attending the venue.

7.4          We reserve the right to refuse admission or remove you from THE CUBE without any right to a refund in certain circumstances and these are likely to include if you have consumed alcohol or illegal substances before attending, are involved with abusive, threatening, drunken or other anti-social behaviour, or carry offensive weapons or illegal or prohibited substances or make unauthorised audio, video or photographic recordings.

7.5          THE CUBE includes vigorous activities that have bespoke features and gameplay.  By attending THE CUBE you accept that you have a duty to take reasonable steps to ensure your own safety, taking into account any personal medical conditions. Care and attention must be paid in the venue to avoid trips and falls.

7.6          THE CUBE is open to guests aged 9 years of age and over. Bookings with guests aged between 9 and 17 years of age must be supervised by an adult aged 18 years or above.

7.7         PHOTOSENSITIVITY WARNING

THE CUBE IS A HIGHLY SENSORY EXPERIENCE THAT INCLUDES FLASHING IMAGES AND LIGHTS THROUGHOUT. THIS MAY BE A CONCERN FOR THOSE WHO MAY HAVE SUFFERED FROM SEIZURES OR EPILEPSY.

PEOPLE WITH SENSITIVITIES TO FLASHING IMAGES AND LIGHTS ARE ADVISED TO CONSULT A DOCTOR PRIOR TO THEIR VISIT IF THIS IS A CONCERN.

7.8          THE CUBE is played in teams of 4 and under no circumstances can persons under the age of 17 play on their own without a supervising parent/guardian.

7.9       THE CUBE is played in groups of a maximum of 4 people and each ticket admits 2 players; this is due to the way that the games are designed as an odd number of players is not possible. If you purchase Tickets for 2 persons only for your selected timeslot, you will have additional players added to your group to create a group of 4. If you purchase more than 4 Tickets in multiples of 2, additional players will be required to play in a separate group that you will not be able to experience the games with for the entirety of THE CUBE gameplay, lasting on average 1.5 hours.

7.10         Upon registering to book at THE CUBE, you will be required to accept these Terms and Conditions. By accepting these Terms and Conditions at the time of registration, you are confirming it is your responsibility to inform all players and confirm their acceptance of these Terms and Condition. If other players decide at any point after purchase they do not accept these Terms and Conditions, no refunds will be offered.

7.11        Please arrive 15 minutes before the time stated on your Ticket. Latecomers may not be admitted and no refund will be offered.

7.12        When attending THE CUBE, please ensure that you carry proof of age. We accept a valid passport, a photo driving licence or a proof of age card such as a PASS card from the national Proof of Age Standards Scheme.

7.15        We use CCTV cameras to assist in the proper running of THE CUBE. However, we do not make any representation as to the extent of coverage provided by the cameras. All items, belongings and other property brought into the Attraction by guests are at their own risk and we accept no liability for any loss or damage to such property. As such, we recommend that guests do not bring valuables to THE CUBE.

7.16        Unless it is expressly prohibited, you may take photographs and/or video recordings of the of THE CUBE provided that these are solely for private use and are not sold or used for any commercial or public purpose.  You agree that we or any authorised third party may use such images in perpetuity in any promotional or publicity material in any format whatsoever. You further agree that all copyright and any other intellectual property rights that subsist in or arise out of these materials shall be absolutely owned by us or such authorised third party (subject to our agreement) as the case may be.

7.17         The videoing or photography of staff members without explicit authorisation is strictly prohibited.

  1. GENERAL

9.1        These Terms and Conditions and any contract between you and us are governed by English law and any disputes arising out of them are subject to the exclusive jurisdiction of the English Courts.

9.2        No other person shall have any rights to enforce any of terms of the contract between you and us, whether under the Contracts (Rights of Third Parties Act) 1999 or otherwise.

9.3        We reserve the right to amend these Terms and Conditions from time to time and the date these Terms and Conditions were last updated is stated at the beginning of these Terms and Conditions. When you order Tickets from us, the Terms and Conditions at the time of your booking will apply to your contract with us.

9.4        We do not accept any responsibility for any loss and/or damage you suffer as a result of you failing to comply with these Terms and Conditions. This does not affect any of your statutory rights or any liability on our party which cannot be excluded by law.

9.5        Each of the paragraphs of these Terms and Conditions operates separately. If any court or relevant authority decides that any of them are unlawful or unenforceable, the remaining paragraphs will remain in full force and effect.
